Terms of Service

1. Acceptance of Terms

By accessing or using Gachato (“Platform”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform. These Terms form a legally binding agreement between you and Gachato.

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the new Terms on the Platform. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms.

2. Eligibility and Account Creation

You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that you are 18 or older and that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are found to be fraudulent, or engage in prohibited conduct.

3. Virtual Currency (Credits)

Gachato uses a virtual currency system called “Credits” within the Platform. Credits are used to participate in blind box draws and other Platform features.

• Non-Refundable: All Credits purchases are final and non-refundable. Credits have no cash value and cannot be exchanged for real money, goods, or services outside the Platform.
• No Cash Redemption: Credits cannot be withdrawn, transferred to external accounts, or redeemed for fiat currency under any circumstances.
• Expiry: Credits may expire if your account is inactive for an extended period or upon account termination.
• Welcome Bonus: New accounts receive a welcome bonus of Credits at no charge. Bonus Credits are subject to the same restrictions as purchased Credits.
• Referral Commissions: Credits earned through the referral programme are subject to the same restrictions and are awarded at our discretion.

Important: Credits are a virtual entertainment currency. They do not constitute a financial instrument, investment, or store of value. Gachato reserves the right to adjust Credit balances, pricing, and exchange rates at any time.

4. Blind Box / Gacha Mechanics

Blind box draws on the Platform are randomised. By participating in draws, you acknowledge and accept the following:

• Random Outcomes: Each draw produces a randomised result. You are purchasing the experience of a draw, not any specific item.
• Provably Fair: Our draw engine uses cryptographically secure random number generation (CSPRNG). Each draw is assigned a unique RNG seed for auditability. Win-rate percentages displayed are approximate probabilities, not guarantees.
• Pity System: A pity guarantee ensures you receive an SP-rarity item within a configurable number of draws per series (typically 80 draws). The specific threshold is displayed on each series page.
• Displayed Probabilities: Item probabilities are displayed per series. These represent the statistical likelihood of receiving each rarity tier and are determined before any given draw is executed.
• No Guarantees: Past draw results do not influence future draws (with the exception of the pity system as described above).
• Entertainment Purpose: Blind box draws are intended for entertainment purposes only. Results are final once a draw is executed.

5. Marketplace Rules

The Gachato marketplace allows users to buy and sell virtual items using Credits. By participating in the marketplace, you agree to:

• List only items you legitimately obtained through the Platform.
• Set fair and accurate pricing; we reserve the right to remove listings that are excessively priced or abusive.
• Complete transactions promptly. Confirmed purchases are binding.
• Refrain from price manipulation, collusion, or market abuse.
• Accept that all marketplace transactions are final. We do not guarantee any particular resale value for items.

Gachato is not a party to marketplace transactions between users. We are not responsible for disputes between buyers and sellers.

6. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or manipulate the Platform’s draw engine or RNG systems.
• Use bots, scripts, or automated tools to interact with the Platform.
• Create multiple accounts to exploit welcome bonuses or promotional offers.
• Harass, abuse, threaten, or harm other users.
• Post or transmit content that is defamatory, obscene, hateful, or infringes any third-party rights.
• Attempt to circumvent any responsible gaming restrictions you have set on your account.
• Engage in money laundering or any financial crime using the Platform.

We may suspend or permanently ban accounts that violate this conduct policy, with or without prior notice, at our sole discretion.

7. Responsible Gaming

We are committed to responsible gaming. We provide tools including self-exclusion periods, daily and weekly draw limits, and session timeout settings. You can manage these settings in Responsible Gaming Settings.

If you feel that your engagement with the Platform is becoming harmful, please use our self-exclusion feature or contact us. Tightening your limits takes effect immediately; relaxing limits is subject to a 24-hour cooling-off period.

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, item designs, animations, and software, is the property of Gachato or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from any Platform content without our express written permission.

Virtual items obtained through draws or the marketplace are digital content licences, not physical property. You do not own the underlying assets; you hold a licence to use them within the Platform.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

10. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any loss of Credits or virtual items resulting from technical failures, downtime, or data corruption.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMON AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law.

12. Termination

We may suspend or terminate your account and access to the Platform at any time, for any reason, including but not limited to breach of these Terms. Upon termination:

• Your Credits balance will be forfeited and are non-refundable.
• Your virtual item licences will be revoked.
• Active marketplace listings will be cancelled.
• You may request deletion of your personal data in accordance with our Privacy Policy.

You may also close your account at any time by contacting us or using the account deletion feature. Financial transaction records are retained as required by applicable law.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of [Governing Jurisdiction — to be confirmed], without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Platform shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of [Arbitration Body — to be confirmed], unless prohibited by applicable law.

Nothing in this clause limits your rights under applicable consumer protection laws in your jurisdiction.
